Любопытный аргумент. Лично мне вспомнилась история о вожде Ahenakew, которого судят за антисемитские высказывания. Вот что говорит его адвокат:
Ahenakew's lawyer, Doug Christie, says intent will play a key role in his defence arguments.
"There's no intent to promote hatred," he says. "Free speech is important, whether you like it or not."
Christie wouldn't comment on his client's health other than to say he is ready for trial. During the first trial, Christie argued Ahenakew's comments were influenced by his diabetes, a few glasses of wine and a change in medication.
Christie says the reporter is the one to blame for publishing the comments in the first place.
"Wilful promotion of hatred - if that's the crime, I hate to tell you, but the only person who really committed it was the person who made it public."
